Arizona Attorney General Mark Brnovich is urging his state’s Democratic censors. Kirsten Sinima and Mark Kelly do not support their party’s push Supreme Court Expansion.
In a letter sent to senators on Tuesday, Brnovich raised concerns that expanding the number of Supreme Court judges could be detrimental to the government’s system of checks and balances.

“I was very upset to learn that Congress could soon enact amusing legislation to dramatically redesign the United States Supreme Court. Similarly, President Biden recently created a Presidential Commission in the United States Supreme Court, which would examine, among other things, the membership and size of the Court, ”Brnovich wrote.
“The expansion of the size of the Supreme Court will not be less than a direct attack on judicial independence. The foundation of our constitution rests on the assumption that power is divided between different branches of government. This unique system creates checks and balances – an essential defense against any form of atrocity. ”
Brnovich accused Democratic lawmakers of spearheading efforts on a bill attempting to grab partisan political power, calling for Sinima and Kelly to oppose the measure if it comes to the floor.
“History has shown that when elected officials propose legislation to change the structure of the Supreme Court, their real objectives are nothing short of noble. In fact, these misleading actions have almost always attempted to circumvent the principles of the Constitution in search of power, ”he said, adding that late Justice Ruth Beder Ginsburg expressed reluctance to pack the court.
Brnovich advocated against the term limit for judges, arguing that it would “undermine their ability to stay on the law.”
“The institution of the Supreme Court, and other branches of government, should not be held accountable, but only according to the Constitution of the United States, the term limit for justices does not exist, so they can remain focused on the law and not the letter stated. With changing political trends and special interests.
“The Supreme Court should be protected from the tyranny of the majority in order to preserve the rights of minorities. I urge you to expressly and strongly oppose your constitution and any attempt to curtail the independence of the judiciary. ”
Sinima – a liberal Democrat – and Kelly have previously expressed reservations about adding additional extras. A spokesman last year said, “Senator Sinima opposed the court-packing.”
