DOE should provide NYC charter schools with COVID-19 tests

The Department of Education should introduce COVID-19 testing in charter schools, a court ruled on Friday.

Justice Frank Nervo of the New York County Supreme Court determined that Doe “will and will provide COVID-19 screening tests to students and staff of charter schools on the same terms as the test provided to public schools.”

The decision is a win for charter schools and families, who complained that the city wrongly denied coronavirus tests despite public schools receiving them weekly.

A lawsuit filed in Manhattan Supreme Court in December alleges that charter schools should be entitled to the same testing requirements as DOE’s public schools because they receive public funds.

Many of the charter schools were forced to go completely remote because they could not withstand trials according to the suit, which was filed by schools including Zeta, Renaissance, Classical, Public Preparation Academies and Ascension .

DOE did not immediately respond to a request for comment Friday night.
