ALBANY — Former Gov. Andrew Cuomo has been ordered to appear virtually in court on Friday by a judge tasked with considering a request to dismiss a misdemeanor sex crime charge filed against him.
“The District Attorney, the defendant and his attorney will appear virtually. The judge will be on the bench in the courtroom and the court room will be open,” said Lucian Chalfen, spokesman for the New York Office of Court Administration on Thursday.
Cuomo, 64, is due in court at 1:30 P.M. in Albany City Court before Judge Holly Trexler, even though county District Attorney David Soares requested on Tuesday that the case be dismissed.
Soares said although complainant Brittany Commisso was found to be “credible and cooperative” the case would be “impossible” to prove at trial.
Candace Elliot, a secretary to Trexler, notified Cuomo’s attorneys Rita Glavin and Michael McDermott via email Thursday morning that “the judge has made a decision that all parties, including the defendant, are required to appear virtually tomorrow at 1:30 p.m.”
Commisso, 33, filed forcible touching charges against Cuomo in August with the Albany County Sheriff’s Office, alleging the ex-governor groped her in the Executive Mansion in Dec. 2020.
A representative for Cuomo did return an immediate request for comment from The Post.
